Legal and ethical constraints / Regulatory bodies

Legal & Ethical Constraints affecting Radio Drama

Constraint

Describe the details of constraint

Explain how the constraint will directly impact on your work

Voice artist release forms-

Clearances and permissions

This is a form that’s shows the actor can be recorded or filmed and, in this product, can be published online so this is a consent form

If this form is not filled out the people that are involved on the radio drama and the radio has been published the actor can sue me which can impact the actual radio drama itself

PPL

Public Performance Licensing (PPL) in the UK provides legal authorization for the public use of copyrighted music by obtaining a PPL license, you ensure that you have the legal right to play specific songs in public venues or events this license ensures that artists, performers, and record labels receive proper compensation for the public use of their music

This will impact my radio because if I have not got consent from the actors then this could impact my product if published but I would have them sign a release form so the nothing happens to me or my product

PRS

PRS (Performing Rights Society) is an organization that grants you the rights to listen to music on the radio and in public spaces

This radio would be private and the only people with the link would be able to listen to the radio

Royalties

This is when you have as fee when someone uses or wants to use your product

This would help me keep ownership and I will have a source of funding from this radio drama

Copyright

This is to make sure that no one else is using my product and its only owned by me

This is to stop anyone from copying my work and using it for themselves this would prevent any people from using my radio drama

Offensive content

Offensive content refers to material created with the intent to offend a specific audience, potentially resulting in a loss of listeners

In my radio I would not have any offensive terms because I want it to be formal and be educational and stay like that

Slander

Slander is akin to defamation, involving the verbal communication of false and harmful statements about another person

In my radio I have the same thing as non-offensive content because I want it to be formal and be educational so there would be no slander

Defamation

Defamation is like slander, involving false statements about a person that could potentially cause harm. This could happen to one of our voice actors

In my radio I have the same thing as non-offensive content because I want it to be formal and be educational so there would be no slander or harmful things

Representation

Representation refers to how the media portrays society and the real world. It utilizes codes and conventions to convey ideas, topics, and meanings in what is being presented

This wouldn't be a problem because my radio interview is to educate people the impact of social media to business and a lot more industry

Regulatory bodies:

Ofcom: Ofcom (Office of Communications) is a government-approved regulatory body that oversees broadcasting and television across the UK, when creating media products, we must adhere to certain rules set by Ofcom.

Protecting the Under 18s: (Section 1)

This section emphasizes the need to protect individuals under 18 by ensuring content does not Impair their physical, mental or moral development, appear inappropriately scheduled and include unsuitable content for children under 15.

For my radio project, I must ensure that the content does not harm under-18s, especially since the topic can be sensitive so then the message must be delivered in a way that avoids causing harm.

Harm and offence: (Section 2)

This section advises against including content that may harm or offend the audience, including misleading portrayals in programs and harmful or offensive material

For my radio project, I must ensure that the content is neither harmful/offensive While discussing social media, I must use words carefully to avoid offending anyone or minimize their use.

Crime, disorder, hatred and abuse: (Section 3)

This section prohibits content that involves severe crime, disorder, hatred and abuse, such as content calling for criminal action or disorder and speech that may incite criminal behaviour

For my radio project, I must ensure that the content does not lead to any harmful actions by the audience. I will deliver my message positively, ensuring that the voice actors avoid promoting crime, disorder, hatred or abuse.

Religion: (Sectio 4)

This section requires respect for religious beliefs and prohibits when disrespectful treatment of religions and abusive content against religions

For my radio project, I must respect the audience's religious beliefs and ensure that the content does not offend them in any way.

Commercial communications in radio programming: (Section 10)

This section outlines the guidelines for commercial content in BBC UK radio broadcasts, ensuring transparency and distinguishability from editorial content to protect listeners from misleading advertising and mistreatment. Key rules include:

Sponsorships: Clearly identifying sponsorship at the beginning and end of programs

General Principles: Ensuring listeners can easily distinguish between commercial messages and editorial content

Content and Scheduling: Avoiding misleading claims and offensive material

Overall, this section ensures that radio stations, like the BBC, are responsible and maintain listener trust by being transparent and compliant with legal requirements regarding commercial communications.
